Determining validity of deleted prepaid account from the sim

Hello Sir

                I have a consumer dispute pending against Airtel where the latter had deleted my prepaid account in 2011 without assigning any reasons though during the course of argument it is insisting that I had not submitted any KYC documents during the verification drive and validity of the connection had expired which is not true.  Interestingly the respondent fails to produce a single piece evidence in support of their claim. Neither the show clause reply is submitted in the form of an affidavit nor it is verified by the respondent\. Only the reply is produced before the court with the signature of the Advocate that too recently after 4 years from receiving the notice.

                    That prepaid number has been allotted to another customer since the date of  deletion of my account for which I have filed this complaint  against illegal deletion of my prepaid account.

                    When they have no evidence to support thier claims and the number is already allotted to another, in spite of having the original SIM with me, can the SIM be helpful in establishing the validity of the number?

                    Is there any TRAI rule where I can argue to get back my Call Data Records  for the period before  deletion of account i.e. even after 4 years of deletion of my account . If yes kindly quote the rule.

Insist that reply be signed by company's competent official on letterhead with seal, in court and this official also provides its I.Card.

 

The 4 years call log data if to maintained as per law has to be maintained and produced as per court order.

It is felt that CDR ( Call Data Record) is  preserved for 7 years by MSP's.

But Sir, I just want to know can the original SIM of the prepaid  number initially allotted to me before deletion and  later reallotted  to another customer since the date of  deletion for which I have filed this complaint  against illegal deletion of my prepaid account, would be helpful in anyway technically  in establishing validity of the number as the defense counsellor justifies deletion of the account citing non-submission of KYC documents as well as  expiration of validity for which I do not have any proof to counter them.
