Dir recorded and used as an evidence at some later stage.

can wife approach to a protection officer and record a dir and obtain a copy of same and can use it at some later stage as an evidence.

 

In few paras in above linked mannual such indications are there.

 

 experts please throw some light.

The Dir filed is based on the narration provided by the aggrived person and the protection officer without investigation signs on it .

Yes you can file this DIR as an evidence which is proved that you have filed a DOmestic violence case against the person only.

i dont want to file DV as I cant due to a simple reason for being a married MAN in INDIA.

 

I suspect that my wife and in-laws who are very cunning and wicked might have filed dir in past and now sitting quietly and may file the case at later stage according to their convinience just to harass me and my familly.

 

Six months back wife deserted me and till then demanding me to live separately from my family and disown them, then only she will join me. All mediations failed. In past six months they never called me its only me who calls them and tries to resolve amicably but all efforts were futile.

 

On recalling the conversations which took place in last six months I can say that they are with ulterior motives. I was trying to assure them that I loves my wife and we are happy with eachother and in return they were talking about their expenditure on marriage, her rights, self defence, dignity of woman, a small separate accomodation for her and me if I cant leave my parents I can visit them and in that separate accomodation her mother will acompany her & all such stupid nonfeasible things.

 

Constantly they misbehaved and were making baseless allegations. When I condemned them then they asked me to wait and watch, in future I will come to know everything.

 

Considering their usage of few terms and demands I suspect that they may go for DV and higher possibilities are there that they might have recordrd DIR and  now sitting quietly and may file the case at later stage according to their convinience just to harass me and my familly.

 

Now my worry is how to know wheather such DIR has been recorded or not.

If its recorded then what can be done to save from further legal complications.

Dear Victim , 

When a DV case is filed summons would be sent to you . there is no point worrying about the same. If the allegations are false in the DIr she has to prove the same in court  . In DV case there is no arrest . She can claim reliefs like right to residence , If she is not working may ask for maintanence etc . In case you have a property in your name get it transferred to either of your parents name and remain cool .

If you feel your marriage would work out and you have the resourses than take up a small accomodation for both of youll were you can meet up with her and have your privarcy and be with your parents as well  . Since one day your parents would be no more and than you would be all alone . Marriage is a matter of compromises .

You can accept Stanley's advice...

But to my mind....

if you say that both you were happy....then yr wife is not a child...to do all this thing she should have some maturity....

why r u waiting for DV and other criminal matters to be filed agianst you

you better file Divorce Petition...

if yr wife is shattered, she might come back to you if she loves you...and then you can fiel consent terms on trial basis.   if you go alongwith well...fine, if not contest divorce petn...

can divorce be filed at this stage it has been only 10 months old marriage. And out of which 6 months of desertion.
