Erring Directors !!

Pleadings to the effect that a director is active and is liable should not be made mandatory. The burden of proving should be on the respondent/accused who says he is not active director, by producing ncessary documents... provide inputs, cases if any!!??

When the complainant is dragging the directors, why should he not prove how the director was responsible? Supreme Court has held repeatedly that it is for the complainant to aver in the complaint and prove. The common perception is that what one says, he has to prove it.
