Adv.Shine Thomas (Advocate) 20 September 2008
Sec 37 to 39A of the Copyright Act deals with the rights of performers and brodcasting organisations.
N.K.Assumi (Advocate) 21 September 2008
In addition to Mr.Shine, let me add that, lack of rights to the performance of an actor, musician and dancer and so on was a great lacuna in the copyright law. This lacuna has now been remedied by the copyright Amendment Act of 1994 for the first time by introducing certain special rights called "performers' rights for the benefit of various kinds of perfprmers like actors, dancers, musicians etc. these rights are somewhat analogous to broadcast reproduction rights. As per section 2qq of the act, performer includes an acrobat, musician, singer, juggler, snake charmer,a person delivering lecture or any other person who makes a performance. As per section 2 q " Performance" in relation to performers' right mean any visual or acoustic presentation made by one or more performers.
