Fd not created but fdr issued

I am bank staff. FDR was issued erroneously by bank with the instruction that bank will debit the fd amount from the bank account of customer, however fd was not created and presently customer is demanding the the fd amount with interest, despite no loss caused to him. Consumer court is also supporting customer. 

Please help.

Hello,

Consumer commission is right. Bank consumer may be in loss of interest. Not creating FDR is deficiency of service caused to consumer by bank.

There are several such decisions in favor of the customer, as the customer has kept the amount and not used it.  There is negligence and deficiency of service by the Bank, although the customer is having constructive knowledge and should have reminded the branch staff. (As FD Receipts are now dispensed with automatic transfer facility these types of mistakes do happen)

Admittedly, the Bank was holding the amount, though FD not issued. It is judicious that interest be paid.

Thank God, no disciplinary proceedings were initiated against gross negligence in parting with an FD receipt without actually receiving the money..
