Hakkasod patra

Hello,

One of my friend has a property which was constructed by his Grand Father [Paternal] around 70 years back.

his Gradfather has 3 children , 1 male [his father] and 2 female. Since, his grand father died after the property built and only her father's name was put as a minor under sole waras during that period.

The name of 2 aunts [sister of his father] was not put on Property card.

now, recently his father also died So, he and his siblings name put on Property card as effective sole waras.

Now, he intends to reconstruct the property with builder, The builder / bank insists to have a Hakksod letter form aunts and the 2 aunts are also ready to give Hakkasod letter on my Friend's name but in this case where the aunts name is not there on property card how this could be done ???

Since this is a 2nd generation to 3rd generation transfer then,

What's the overall process to get it done ??  its bit urgent   Can you please explain alongwith some law section references ? 

Will there be any stamp duty ? i heard there can be some 5% stamp duty need to pay... Is there any alternate way to this ??
