How to cancel a booked flat?

I booked a flat worth 20 lakhs in March 2013, the completion as per agreement is Nov 2014. Now the builder says it would take another 12 to 15 months. I have paid 15.5 lakhs, also I am paying pre EMI monthly.

For the past 8 months no progress in construction and many flats are still vacant, I doubt if they can complete even with 12 to 15 months. So I decided to cancel and asked the builder about the same.

He said, only if he sells the flat to someone else he can settle my money. When I protested, he said he has to talk to his MD. Now after 6  days I call him and he never picks up. I have mailed him but in vain.

Also the agreement has no clause for cancellation. But it has some 24% interest to be paid to me if not handed over in time.

What should I do?

first send legal notice to builder to cancel ur flat and refund ur total paid amount within 1 month time failing which u can file consumer complaint in CF.
