Independent cultural committee

Hello,

Our society has around 1000 house and we have residents welfare association which is a registered body. Due to the reason the management committee is not acting properly, a set of like minded residents started a cultural committee and pooled in some funds to organize cultural events. Now the management committee is forcing the cultural team to deposit the collected fund in the association account stating the reason cultural team is using society facilities to organise events.

Now the cultural team is deliberating the option to registered the cultural committee as an independent body. But we are not sure if that is possible. If it is possible, how can the independent Registered cultural committee use the society facilities without approval or support from society association? Need guidance in this aspect.

The apartment complex is under the control and governance of the association which is a registered body.

Now the proposed cultural committee either should be a part of the association or it can function from outside the association in the interest of the members of the committee.

It cannot operate as an independent entity within the housing society association.

Even if it is a registered independent committee, it cannot interfere in the affairs of the existing association, especially if it has not been permitted to function as a separate body within the assocaiotion

How do we handle the funds that were pooled in by the cultural team? Appartment committee is asking the cultural team to deposit the funds into the association account. Cultural team doesn't want to deposit as they believe the funds won't be used for cultural events.

 

Can the cultural team maintain a separate personal account for these funds? Will there be any problem to do so?

The cultural team, uc not a part of the association, the head of the cultural team can refuse to accede the instructions of the association.

The association cannot interfere with the activities of the cultural team provided they are being organised outside the complex of the association.

If the association is still insisting on this, you can issue a legal notice on behalf of the cultural team to the association warning them about the legal consequences if they try to interfere with the cultural team's affairs.
