IPC 279

Under Section 279 of the Indian Penal Code, any individual who is driving or riding a vehicle in a negligent manner, thereby endangering human life, will be punished by law. 

If the accused is implicated in this case falsely then you can put suitable questions to the eye witnesses or the defacto complainant that whether they have seen the accused driving the vehicle negligently or in a rash manner, if so at what speed and how and when they measured this speed or how did they come to know he drove the vhehicle negligently
