2. The above is evident from the scores of litigancy pending before the Cooperative authorities /courts, since ages.

It is mandatory to register a cooperative housing society. However in respect of societies formed under Maharashtra Apartment Ownership Act 1970, once a Deed of Declaration is registered by the Developer/builder, then it is not necessary to register the society again. The DOD contains the Bye-laws also under which all the purchasers become members automatically and they are bound to follow the bye-laws. However legally such societies are very weak so far as implementation is concerned because of certain infirmties in the provisions of the Act. The Act does not clarify as to what are the powers of the executive body if any member does not pay the maintenance charges for common fund. The result is that in every society formed under this Act in Maharashtra there are ample number of defaulters and the President or the Secretary of the Society is unable to take any action against them in the absence of any law backing. Can anyone sugguest a better way out so that the societies formed under this Act function smoothly. The State government must pay due attention on this acpect as the provisions of the Act deserve to be amended suitably. The suggestions are invited on this aspect from members of the club.

See people say there is no use of giving suggestions etc. Still, I went and gave suggestions one here and other at PMO in two different subjects, concern things were adopted , I am sure similarly many may have suggested same thing which I may have suggested but just seating idle and not doing anything you won't get anything.
A child too requires crying so mother knows the child is hungry.
