Late possession of flat noida

I have a flat in AMRAPALI ZODIAC area 2300 sq. ft. according to agreement had to get possession in june 2012 with penelty clause of Rs. 10/- per sq. ft. per month. Despite my meeting with officials and repeated emailing, I have not get possession and also penelty. Now the flat is ready for possession, Should I take possession and demand penelty? or I Should go for settlement of penelty first and then take possession. Is there any lawyer available for taking my case to consumer court. Will I get full penelty or I have to settle for lumpsum amount.

It shall be appropriate to show all documents and record of communications to an able counsel specializing in consumer matters before you act.

What is the value of your property?  You can file the case in State Commission or in National Commission. If the value is less than 1 crore, you have to go to State Commission if it is more than 1 crore, you have to file in New Delhi.  

           I have recently filed a similar case.  Better file it as soon as possible.  If you have time, you can come and meet me on Saturday or Sunday, with all the papers.  I live in Dwarka, New Delhi
