Legality of appointment letter issued before candidate actually joins?

What if instead of releasing offer , companies starting releasing #appointmentletter subject to joining on or before a given date.

Considering that the appointment letter is actual contract of employment once signed , both sides have legal obligations, candidates will stop offer shopping , companies will stop retracting offer and get get to know of a candidate is serious or not and genuine candidates will start being valued .

What are the legal implications of this ?
Can a candidate sign new appointment letter post resignation in current company , prior to getting relieved ?
