lie detectors & brain mapping tests

Dear All,

I wanted to know,

1.To what extent are results of lie detector tests, brain mapping tests as well as narco analysis admissible in the Court of law.

2. Can the person/ accused upon whom the above tests are to be conducted refuse to have them conducted upon him?

3. Can these tests be the sole basis for conviction? If so, in what cases/circumstances?

The resusults of such tests are admissible in court only when there s collaboration with other evidences on record.




 


no accused cant refuse to undergo such tests and it is upto the court to decide on the issue. held so by ahamadabad high court in santok ben vs state of gujarat in 2006.




 


prior approval of the court to subject the accused to such tests is mandatory.

read section 45 to 51 of evidence act. its a corrorroborate evidence under section 157 of evidence act.
