My case has come for hearing recently and one of the questions raised is limitation as I raised the issue after 16 years with respect to my promotion. But neither our organization nor our ministry to whom I appealed before going to CAT rejected my representations based on delay. Now before the CAT they are arguing about the limitation. I have come across somewhere that if organization did not dispose representation on the grounds of limitation/delay then it cannot come under the purview of limitation act. Is there any decision by any court in this regard. or is my interpretation wrong. Please let me know..
