Mou for redevelopment of housing society

Hi,

Our society is going for redevelopment, thedeveloper/builder is the son of the secretory. The Registered office as mentioned in the Offer letter of the developer is the flat owned by the secretory. Would like to know since the building is going for redevelopment, can the society enter into an agreement with the developer whose registered office address is in the same building. He however, has mentioned a correspondence address in the offer letter.

 

Kindly advice on the matter.

Sir,

Under Bye-laws of the society, it has specifically stated that, the Developer of the society shall not be a member of the society and/or otherwise should not be relative of the member of the society.

 

How your society is appointing a member's son as a developer?

Thanks Sir for your valuable advice,

Though some members have objected to the appointment, the chairman  of the society has tried to convince most of the members that this will not be an issue as most of the members are agreeing and are ok with the developer being the son of the secretory...

Now they are trying to convince other members to sign on the MOU...

since this is against the bye- laws what implications it will have if the majority of the members still go ahead on the redevelopment proposal.
