Not geetting reliving from comany

Hi Sir

I am working in a organisation from the past 11 months .As per my offer letter i have to serve 3 months notice period and i am not in any type of bond or  agreement.I am working in the comany's client location .I have resigned from my services before 4 months still i haven't got any confirmation about my relieving date and they are asking me to serve until the replacement join. Now they are telling like initial resignation was not accepted by the management and you have to serve until the replacement came to the client location.

1)In any organization management can restrict the employee resignation by not accepting the resignation

2)Can i proceed legally further

Your liability is the most to serve till notice period or compensate for the shortfall in notice period.

Employee can not be forced/ coerced to wait till replacement joins. Employee is to be directed to whom to handover the charge and if no employee is designated as replacement employee should try and handover the charge/company property to HOD.

If the notice period has already ended and you have continued to be in service you may have to issue another notice. Company has exploited your ignorance.

You may approach your lawyer with records and your lawyer may be able to help you.
