Nri owners are eligible for co- opted mc member?

How can the MC, the management committee, and President appoint an NRI owner as Co-opted member of MC of a apartment of owners association. The very first eligibility is that he shud be a residing owner of a flat in the apartment building, and can there be otherwise provided in the bye-laws? Or vested powers of the president of the elected MC 🙄 🤔

Only housing society members are eligible to become committee members.

Outsiders are not allowed to serve on the committee.

The NRI is an owner hence until and unless he is not disqualified for various other reasons as mentioned in the bylaws, he can very well be co-opted to MC as its member.

Thank you Sir for your swift response. Even If it's stated in the  bye-laws that as an NRI owner not residing in the apartment  are not eligible to stand in the MC member election ? Still he can be appointed as Co-opted Member? Is there any resolutions passed in AGM required or simply President can make an announcement in AGM on such appointment?

The decision to appoint a  co-opted member to the MC will be takn by a meeting of the MC members.
