properties not mentioned in plaint

We have a muslim partition suit still pending in final decree proceedings, Final decree proceedings started in the year 1986, The suit was preliminary decree in the year 1960,

 

Unfortunately or unknowingly some properties are left over without including in the plaint of Original suit which was preliminary decreed in 1960, As these are also family properties which were not included.

 

Question: Can now these properties be included in the Final decree proceedings for partition and separate possession? if so under what is the procedure ?

Dear Mr.Mohammed Ali,

The same can be done by filing Order VI Rule 17 Application before the court detailing the legitimate reasons for the same.

hello sir

you can't include the propoerties in the final decree proceedings you have to take initiate steps in the plaint so please ammend your plaint by filing the application in the trail court
