Punishment - Increment Stoppage

Employee was granted annual increment on 1-03-11 in private establishment.  In may he committed a offence and after conducting an enquiry, he was found guilty and the employee also admitted his mistake and offence. He was awarded punishment of stoppage of increment for one year w.e.f. 01-05-11.  Can the employer reduce the present increment which he got from 01-03-11 and pay him less the increment from 01-05-11 with the direction that he will be paid next increment from 01-05-12.

Is this order correct or he should have awarded the punishment from 01-03-12 to 28-02-13 after completion of his one year of his increment on  28-02-12.  Please advice the validity of order already passed and  from which date the increment should have been stopped.

Sir,


Increment once sanctioned cannot be withdrawn on subsequent punishment. The order of stoppage of increment should be given effect on the date of sanction of next increment.
