can anyone please discuss this question

A research team working with company CRO completed a very difficult R&D project. CRO has filed a

provisional patent application on October 10, 2009 in its name. Since then. Itsresearchers have worked

further on the invention and are now in a position to file a complete specification. The complete

specification is expected to have 61 pages and 113 claims. There are 3 new inventors, of which 2 are

foreigners from another institution "CRY" whose names have to be included in the patent application.

There is an understanding between "CRO" and "CRY" that the patent application will be filed jointly in

the names ofthe two institutions.

Suggest a plan of action for the filing of the relevant patent application including the timelines, the

essential forms to be filled, fees to be paid and associated formalities to be completed to ensure that

the application isin order.

hi,

documents to be filed are : 

complte specification should be filed on or before october 10,2010 (acc to section 9 , form 2)

statement and undertaking(section 8 , rule 12, form 3)

declartion to inventorship (section 10(6) , rule 13(6) , form 5)

to include the name of cry (section 57 , rule 81(1) form 13)

proof of right within 6 months form date of filing of application

 

as for the fees

4000/- for the standard application

extra sheet = 61-30 = 31

31*400 = 12400

extra claim = 113-10 = 103

103*800 = 82400

total  = 4000  +  12400 +82400 =98800
