I want to file an objection letter to banks to stop account operations as one of the legal heir is aggreived. Father died intestate and made one of his sons joint account holder.. So what should be the format other sons can follow to write an objection letter so that bank do not disburse money unless it is mutually settled in court. Kindly provide me the proper format of objection letter on behalf of my client as RBI says nominee/ either survivor account doesn't mean they can ignore legal heirs right to claim. There is no will of the deceased father.
Just give detail of account and mention the name of legal heirs , inform bank lthrough the medium of legal notice to freez the operation of accoiunt until the sucession certifiactes are not presented . Warn them if they failed to stop the operation of account and if the account is operated by anyone whether nominee or else until the certifitae of sucession or a contested court order, the bank shall be solely laible and responsible for the cosnsequences.
They will never let anyone to operate the account until receving court order or sucession certificates.
Meanwile apply to court with declaration suit and seek instant stay on operation of accounts.
