Redressal for managers

Dear All,

As known to all Factories Act is restricted to redressing the problems of only workmen or those covered in it's definition. But an interesting question is that is there any law to protect the interests of management staff (exept civil court). As we all know civil courts are open to all. But their procedures are very cumbersome and time consuming. Is there any other forum for management staff to redress their problems? Kindly provide valuable inputs on this topic.

Dear Avinash,

 

Kindly read definition of "Workman" given under various laws. Managers also a workman, depend on the nature of the work he does. For e.g. if any Mananger working on floorshop of the factory, in such situation Manager is also workman. The staff which who is sitting in the factory is also workman.

yes i do agree with mr jayant, he well indicated , all the workmen are come under the employee list even management staff or floor staff.

The labour act also give its prime role to help all staff .

Dear Mr. Jayant & Mr.Sankar,

I do agree with you that manager & supervisors working on shopfloor comes under the perview of workmen(as held by various High Courts also) in Factories Act, but the question is wheather other than working on shopfloor have any remedy under the Factories Act or any other law ( other than civil law ).

Dear Avinash,

 

You being related to HR can try to make adequate provisions in fhe Staff manual for appeals and appellate authorities, disciplinary committee, etc. within the organisation to deal with cases of attrocities and injustice being meted out to the managerial staff by superior authorities.

Mr. Sharma has initiated a very meaningful and interesting discussion.

Learned Mr. Dhingra has given a very practical and wise advice.

Some of the companies form grievance redressal mechanism and issue email id to lodge greivances at that email id and a personnel of the level of Director may head the committee.

However in majority of the companies it may just be for the name sake and during the testing times managers may find the whole game as eye wash.

Thus if you act to “make adequate provisions in fhe Staff manual for appeals and appellate authorities, disciplinary committee, etc", as suggested by Mr. Dhingra, it shall be great job done. You shall be applauded, by one and all.
