Rental agreement

Hello sir,


I am having a own house that is for rent in my native, the previous tenant has given big problem to vacate.

So my question is is it safe to have rental agreement with next tenant. I heard like if we give rental agreement and if tenant is staying for more that 4 yrs then tenant will automatically gets some rights on the property.

Can you please suggest what type of agreement I should i have with tenants, so that my job will be easy to vacate them in case of any problems(like not paying rent, causing disturbance to other etc) by giving proper notice period lets say 1-3 months they have to vacate.

You should enter into as Leave and License agreement and more than 5 years amounts to a Lease. You can make it for every 11  months only (to safe guard your interest). A 3 year agreement is also possible. However, it is important for you to incorporate clauses such as to vacate upon notice by either party within 1 month. or as you wish.

Clauses such as disturbance, annoyance and therefore removal of the tenant upon effecting nuisance to others and any alterations etc without your permission,  if done will effect in his/her removal from the property need to be mentioned.
