Rti to get status of police complaint

Hi forum , Is it possible to file RTI  to find out status of complaint and what investigation / action has been done by police  in response to a complaint filed .( FIR Not yet filed ) ..

Yes You can. You have to apply under Section 6(1) of RTI Act 2005 seeking the copies of all the note sheets/copy of complanit, action taken report regarding Complaint filed.

if no action taken on complain, please give me the reason for the same.

No under RTI Act you will be given only whether the FIR has been registered or not, but they will not disclose the details of  progress in the investigaton. That can be disclosed only after investigation.

There is an order of Hon'ble Shailesh Gandhi, erstwhile Information Commisioner of CIC that if investigations are not completed in "reasonable time" then Section 8(1)(h) of RTI Act 2005 is not a bar to disclose information.

You may try by filing RTI application by stating that "considerable time" has elapsed and as such the copy of complaint, action taken report and status of Complaint be disclosed. It works. Try it.
