Salary not paid

Hi,

 

I worked for private organisation for around 4 years. Due to company's financial issues they didn't pay most employees salary for around 4-5 months and deliberately they made us sign "no dues" form before giving the relieving letter. Now i am asking them for the pending salary from past 1 year and they are not ready to pay, not even replying to our communication mails.

What ould be the best approach to get our salary amount? Please suggest.

None, AFAIK. You should have approached.the labor court earlier.

The employer has to maintain and submit various registers/records as prescribed under various enactments applicable to the establishment and record of having paid the wages/contributions.....

 

e.g. Shops and Commercial Estb Act, Shops and Commercial Estb Rules

Payment of Wages Act

This is clear case of fraud.

 

Unpaid wages are debt on employer.

There is no limitation to approach the tribunal,however you should not delay.

 

You and all affected employees should contact an able labor Law Consultant/Service Matters Lawyer/Law firm ASAP and let your lawyer draft all of your communications now.

I am just curious on this - won't the no dues signed and the delay of a year be held against the worker ? Any case citation / specific law section on this ? Pl advise, thx
