Sec 27 consumer protection act

State Commision vide an ex- parte order directed  a builder for registration of 2 plots in my favour on payment of balance amount, within 2 months of date of order i.e, 19.11.2010. After receiving the order I came to know that during the pendency of the case, builder had got its plan of plotted development changed to High rise apartments, concerned authorities had approved the plan of High rise buildings of builder. Hence I had not deposited the balance amount with the builder. Now I had filed a case u/s 27 of the CPA in District Forum, the builder had replied that as I had not filed the case first u/s 25 of CPA and I had not deposited balance amount within 2 months of order of Stae Commision and further now the plan of plotted development has been scrapped by the concerned authorities, hence the said order of State Commision is unexecutable. Please suggest me what to reply alongwith reference cases.
