Selling part of property.

Dear Sir,

I am the sole inheriter of my parents property via gift deed, both my parents expired few years ago, I have all the Registered documents in my name incuding mutation of the property. For nearly 25 years now my uncle who is our neighbour has been using 20% of our land with permission from my father, my uncle is using the land for gardening and parking only, but the land is within his boundary. Now I want to sell the complete property.

1) Is it legally possible to evict my uncle as he seems to be hostile.

2) Can i sell off remaining 80% property.

Dear querist,

1. If your uncle does have any objection and is willing to give you possession of 20% property you can sell 100%.

 

2. In case any dispute between you and your uncle you can anyways sells 80% of land which is your possession.

 

3. Check with your uncle how he got 20% of land if anything on paper that may help you to get your property back.

 

4. You uncle may file suit for adverse possession.
