Seniority in appointment of SC judges

In a rare move, the Prime Minister’s Office has referred back to the Law Ministry a file containing the Supreme Court collegium recommendations over the elevation of three High Court judges to the apex court. Three senior-most High Court chief justices — A P Shah, A K Patnaik and V K Gupta — had been ignored and judges junior to them were promoted to the Supreme Court. Of the three judges cleared for promotion — Justice A K Ganguly figures fourth in the seniority list, Justice R M Lodha is seventh, while Justice H L Dattu is 27th in the all-India seniority list of high court judges. Please comment you views.

 Sure, Seniority has to be given weight. But what about merit. By saying this, I don ot mean that the others are not meritorious. 


At the higher levels, it is better to have more meritorious, less controversial background, good record etc. 


I am sure, Supreme Court, being the highest court would have considered all these issues before forwarding the file.
