Shop Establishment Act

A Pvt Sector company has isued Transfer order whereby services of employee is transferred to other unit wef 1.11.09. But previous boss insists for handing over assignment to new person . That is also done. But he is not releasing for some vested interest. Handing over & release are not mentioned in Transfer order issued by highest HR President. Can the boss do so indefinitely.

Please advise.

When the transfer order is silent on handing over charge and the same is done by the transferee,there is no reason on the part of the superior in relieving him. In such case the employee can join in his new place of posting pending his relieve orders.

Dotn forget it is not a Govt. job rather you are working in a private job. Oral orders also have equal value as of written there so without any hitch follow the direction or leave the job.
