Statutory bonus fraud

Hi,

I was working with an organization which is established in the year 2000. they give appointment letter where statutory bonus clause is not mentioned as a result they don't give bonus to any employee.

They don't provide confirmation letter to any employee even after completing probation period. Now my question is how can make the company pay the statutory bonus. What legal options do I have if company refuses to pay Statutory Bonus.

I have worked with this company from Oct'07 to Mar'11 in Kolkata and again from Nov'12 to Sept'14 in Bangalore.

For an employee to be eligible for Bonus in an accounting year he/she should have worked in the establishment in that year for at least 30 days. If salary is upto Rs.10000/pm employee is eligible.

Payment of Bonus Act;Sec2(13),8

If you are eligible demand the payment in writing from appointing authority, MD and if no relief is provided approach o/o Labor Commissioner.

 

If there was no break in service then you are eligible for payment of Gratuity as well.

but what is fraud in this case?
