In a summary suit, we appeared for the defendant but could not file leave to defend petition with in the time so the court passed exparte decree. We would like to file petition under O.37 R.4 of cpc to set aside the exparte decree.Kindly send us a model petition under that provision.

Can the court extend time under CPC; despite the frame time under Order 37 and without leave of the court to defend?

Please clarify the stand on 3 Yrs Period to file Money Recovery Suit.
Is it from the date of incident or date from which Legal Notice was sent ????
Also can you please tell me whether one can file Summary Suit for Money Recovery directly in High Court without going to Sessions Court?

date of cause of action is the date of transaction.
