Tenant stays more than 10 years without any legal agreement.

Hi

 I live in Uttarakhand.  i have a house with 2 shops, shops are rented for around 10 years now. and i am living in my house as well.  My tenant stays on my property (shop,) for more than 10 years. There is no legal written documents/agreements between us. They pay the rent as cash in hand each month. I have all property documents & bills on my name.

I have given them verbal notice for evacuating in April and provide them, 3 month time as well. but they are not evacuating and always giving excuses. what should I do?

Will there be any problem in evacuating them, can they able to claim the property or refuse to vacate the property. ? 

What are my options and legal ways to vacate my property? 


please provide advice on this matter.

You need to send them legal written notice for eviction of your premises.

If they don’t comply the same then can file eviction suit in competent court.

Act fast as 12 years period without any agreement will be strong for adverse possession.

Moreover if possible firstly try to settle matter outside court.
