Timtara.com fraud ecommerce legal issues

:  Non delivery of Product  & Harassment  Timtara.com

Order No: r #10285370 Non delivery

The above order for a Nikon Coolpix P510 16MP Digital Camera was placed on July 9th. An immediate online payment was made. Till today I have not received delivery of the product despite being told by both representatives of your customer care that it would be delivered

before July 29th 2012.

second on July 31st 2012.

third on August 8th

As per the criteria of the order and your site delivery should take place within 3 weeks. This has not happened. Numerous calls - emails have been sent along with web complaints on timtara site complaint Ticket #31290 There has been no response. Emails have also been sent to MRr Bose the company head. I have received a delivery receipt but there has been no reply.

Please advise as to the legal issues and what part of the consumer protection law applies. Please also advice what kind of compensation may be claimed. I had ordered the camera for my professional work in the capacity of a photographic project as a senior fellow of the ministry of culture

The delivery receipt is the only reply sent by the company. You may notify the company that although company has sent one delivery receipt you have been pointing out to the company that no delivery has been made to you as being claimed by delivery receipt. If possible you may attach the copy of the delivery receipt in your post in this thread. Did the company mention on its website, order form, confirmation the mode of delivery e.g. courier, speed post or did you mention the mode of delivery desired by you?

Has the company written complete name and address from which dispatch is made and your full name and address phone number on the airway bill if the consignment is sent by courier? Has the delivery boy of the courier seen and recorded the id number of the recipient on the POD and run sheet?

Has any one from the company called you on your phone number registered with the company to confirm the delivery? You may ask the company to provide you all proofs and documents.

Avoid such online portals and rather negotiate well and buy from authorized shops.

The delivery receipt was of the email not the product - Noone from the company has called me - Further a confirmation that the product would be shipped on the 8th of August from their Manager was forwarded to me by consumerdesk.in

If at all product is supplied, open in front of delivery boy, and keep some witness around, check carefully the carton is intact or not, date of manufacturing,  warranty card, data cable, product manual, batteries etc are in order or not, warranty period applicable is for how long etc…….

In case anything is not in order obtain comments of deliver boy on copy of airway bill and copy of his ID card issued by his company and write your comments on run sheet carried by delivery boy and take a photocopy. Do not accept the delivery and inform the local BM of the courier in the presence of delivery boy. Follow up by email and obtain reply from courier. If possible local BM/deputy of courier on the spot and obtain their comments also.

Report the matter to Timtara and attach copies of AWB, run sheet.

If you are not interested to obtain delivery you may claim refund of money + interest+ damages.

It is better to avoid such companies and buy locally. Such companies may not have ready stock and may be in the business of compiling all orders and then buying from company. It has been noted from some of the posts that such companies supply nearing expiry, obsolete products.

If the company does not provide the relief you have the option of lodging a complaint with DCDRF or criminal complaint for fraud. Prior to that you may issue notice to the company from your side.

Legal notice by your lawyer may fetch you relief.
