Typical domestic violence workflow? advise next steps...

Hi,

DV case was filed in Tis Hazari, Delhi Court - in April 2015.
First date was in May when we requested for another date and we will submit the reply to the allegations. We had a lawyer appointed.
Next date is on 24th June.

Just need to understand what to expect on next date? We will submit the reply and the judge would award next date again? Or the arguments for interim maintenance will go on? How frequently a date is awarded in DV matters - in delhi court?

Also, wife has submitted an affidavit stating that she is earning around 50K per month and I am earning close to 80K per month. Can any maintenance be awarded to her based on this?

Please provide suggestions based on your experience with DV cases.

Hi Aman,

Next date your written Say will be submitted in the court and most probably you will get a new date for Interim Argument.

Your wife has stated 80k and 50k salary , are u agreeing with it?

If both parties agree with the salary and you have no child from the marriage, its good for you as a working capable women is not entitled for any reliem until the cruelty is proved.

Be ready with you liabilities list to show your expenditure to let judge come up with your actual in hand income.

 

Dates in Dv or any other cases are given with regards to workload of court. You can request for early dates to court.

if u have a child its joint responsibility of u and ur wife to maintain the child.

 

If wife has asked for rent or house to live in....just ask for her  Salary Slip to be submitted..and in that salary slip show the court that she gets HRA( House Rent Allowance ) and she cannot claim the same component from u as she is already claiming the same from her company.
