Unauthorised online transactons in hdfc credit card.

Dear, I am Rakesh holding a HDFC bank Titanium Edge Credit Card with no 52** **** **** **22. In the July'13 Month statement i had seen 7 international transactions which are unauthorised by me for a total of 53271.37 on my account. These transactions occured in between dates 02-07-2013 to 08-07-2013. The Transaction Details are as follows.

During the time 14-06-2013 till 28-07-2013 i was in germany for office work purpose and hence i couldn't recieve any messages regarding the transactions. I came to know about the disputed transactions only after recieving the monthly statement on 22-07-2013. With Immediate effect i blocked my card and reported the bank about the unauthorised transactions through the format named "Progressive Dispute Letter" as suggested by the Phonebanking Customercare person.

As a Reply to my letter regarding disputed transactions, the HDFC Bank is telling that the transactions are done through Secured website using the secured password, which should only known to the customer. And Hence the Customer is liable for the Payment.

After I am back to India, I had filed an FIR (FIR No. 499/2013) on 21-08-2013 at HAL Police Station mentioning all the details and attached the required documents like statement and mails from the bank.

Out of Interest I had written a mail to one of the merchant (LUXEXPRESS) in the list of disputed transactions asking for information like IP address, consumer name etc., regarding transactions using my Credit Card. They Replied that "There are transactions done on the mentioned dates with the mentioned card number, but the card holder name is different to yours". Also They said that the other details are given only to the Police once they got the proper request from Police.

Now what my doubts are,

1. If the Card Holder Name is Different, how can i am Authorized for the transaction.

2. With this point Can I complain to Banking Ombudsman or Can I go to Consumer Court.

3. Is there any Possibility that I can get my money Back?

Please Clarify me on this Issue how to proceed further to get my money Back.

Since you have already filed FIR let the police investigate into the matter.... Inform Police about the reply you received from LUXEXPRESS...

Thank You Mr.Sastry for your reply.

I had submitted the documents to the Police along with the FIR. They said that they will forward the case to Cyber PS and they will lookafter further Investigation.

My doubt is Is there any mistake from bank like "why they had processed the transaction even if the cardholder name is not matching"?

If its a bank mistake, then with this point can i take this to consumer court?
