Unpaid society maintanance

Dear Sir, 

One of the member of the society, owns a flat and has been defaulting on the payment if the monthly maintenance for the past 2.5 - 3 years. 

The managing commitee has sent in various reminders, but all in vain.

Some of the cheques given by him has bounced back. He states that he is undergoing some financial crisis due to which he is unable to pay the amount. 

We are currently charging him interest @21% as a penalty . 

What should the society do in this case - Please advice.

You may send legal Notice after internal notices. Still does not pay can approach the appropriate Dy. Registrar of Co-op Societies and file case there for recovery after taking necessary approval from the General Body. Recovery is made easy in a co-op. society.
