Vakalatnama misuse

Hello Experts,

Please provide your inputs on this. If I give a signed vakalatnama to a lawer, can he misuse it if the relation breaks with him (like wants to move to a different lawyer etc...). If he does so, what are the chances that we can take action against him...

By way of a vakalatnama, a party authorises a lawyer to contest on his behalf. No lawyer would ever want to lose a case. Winning a case adds to the reputation and boosts the confidence of a lawyer be it a small lawyer or a big shot lawwyer. So working against the interest of the client is a rare . In case of any such case if any you may forward the complaint to the respected bar council in which he is enrolled which shall pursue the matter.

Dear Surya,

You have to be doubly sure before making any allegation against an advocate. If this is so then please take the certified copies of all the documents, which proves that he has misused the vakalatnama and acted against your interests. Thereafter you can take action against that advocate before Bar Council and other appropriate laws.
