When the lawyer turns ugly

 had  there been some provision done on part of law making bodies as establishing some autonomous third parties to intervene in the matter and  investigate the frauds  done by lawyer towards his client.

then the overall task could have been much lighter and safer for the people who've been exploited and be able to come out.

but since there is nothing like that one can hardly take it on his shoulder for debugging the lawyers ..

really its hard to come across ethical lawyers these days i can just name one ..mahesh tiwari sir..a true gem..

Aishwarya, nice question, should have been a raging debate by now.

I am of the opinion that a complaint should be done to Bar Association with a copy to High Court detailing the conduct of the lawyer.

Unethical practises must be highlighted.

I am a law student at this age, because I honestly believe that this profession has given us all what we are thankful today. Civil Liberties, RTI, Constitution and not to forget most of the prominent freedom fighters were lawyers.

The corruption and erosion of ethics is in all fields and is a reflection of the society.

Dear,Asva. your wards,my advocate turns dishonest, is not correct,The advocate was actually not honest ,and you without proper inquary appoint him.It is not nessary.every person wearing Black coat is not of a good charectar.I personal know  many socalled ADVOCATES ,they haven't law decree.PLEASE contact a famous and renound lawyer ,he will guide  you.You can claim damageg from you advocate ,his act  was fraud/cheating.              Don't  mocer about courts , think only for future and law making bodies.

Can someone please explain how to find out about an advocate's conduct,honesty level,his clients' feedback about him,etc before appointing him?

It is easy to say that PROPER ENQUIRY must be done.

So if it is that easy to do,please tell us the formulas of doing it..

dont loose ur faith in rule of law.if ur counsel turned against ur interest, defenitely that amounts to proffessional misconduct and u can proceed  aginst him before the state bar council and they will handle it.That apart u can proceed against him before the consumer disputes redreessal forum and can claim ur losses there that too can do without the help of an advocate.

2. How can the client find out this no.?It's not that the clients requests the advocate to give him this no.,and the advocate happily gives it.

i also want to know how to counter act such lawyers.

i m one of the sufferer.

my lawyer keeps mum in front of judge,doesnot even listen order and dates properly.

misguides me , thats the only reason i joined this forum to have knowledge about litigations .

its best to join such forums get advice frm other lawyers too , nothing else in real i know could be done to counter a fraud done by a lawyer..its quite hard to punish thm for thr misdeeds..

Nothing can be done against lawyer and the punishments given that too in rare cases, and if any, by bar council are a sheer joke.

Public servants are liable to be prosecuted for exceeding the lawful powers ans misuse/abuse of the same. But lawyers are spared from misusing their stature and representing the guilty-client  

But lawyers even though they knowingly and intentionally represent the client (rather become the mouth piece of the client who tells the lawyer to tell lies in court and fix a fictitious story in his case)  and EVEN THOUGH the lawyer gets caught in doing so .................. nothing can be done.

There are cases wherein the lawyer also sliped his tongue and fergot he was supposed to be lying about in connivance with his client and exposed his client (on one hearing client says "client has lost his job and is ill since then and I was also ill and all were taking bed rest at there home in India!!!!" .. that too by filing medical certs....

after a few hearing same lawyers incidently recalls the previous occassion .........

and tells to court that "client had to Germany for official work to visit their bosses in head office as he got promotion in India! and we travelled together to Germany as I was also travelling over on a guided Tour package!!" (same period where client was supposed to be jobless!!)"

But the above incident had caused the other party to lose the contested case ................. and above incident the appellate court wasn't inclined to take cognizance seriously!!!!

Morals of the story: Every one has the fear of law but to prove this rule there has to be an exception

An exception proves the rule!!! .................... So legal profession is the best profession in India.

I find it very lucrative.

Only bar council are empoered to take action (the process never concludes) .......... Bar council does not move any action or at the max gives a reprimand but the the fact that is ignred is that the above mentioned acts had already caused the irreparable loss to victim i.e other party and his life already shattered and already lost energy in running from one forum to another.

First collect  strong evidences and his/her statements of all his/her ill doing.

Then approach to bar council/ high court with a complaint application in written and then file a case against him/her. Also submit supported evidences related to your case.

Words of "ROSHNI B" is right upto very much extent, So re-think before taken any step.

You or your friend get justice by this means as per my knowledge.

Best of Lcuk to you in advance, In present days many lawyers do these type of acts. So we have to expose them too and tried to punish them too by the way of lwas only.
