With liberty

I have been given the following comment from the Judge for a consumer case which I had filed recently. The judge was slightly irritated since there were some small changes needed in the case.

He dismissed the matter and asked for fresh filing by stating:

"In view of the above, the complaint is dismissed as withdrawn.  Liberty is sought for granted. File be consigned to record room."

I will be re-filing - and I suppose I will be given the benefit of the time-period lost (from the perspective of limitation) since the judge has stated "Liberty is sought for granted".

Also, the registrar has stated the judgement will be delivered to my address. What time frame will be given to me for re-filing - is it 30 days from the date of receipt of the judgement?

Pls confirm.

In your case there is no clear cut and there only a direction to file a batter application. As soon as possible you have to file and if there in no indication of the period the it might be 30 days for the date of order.
