Withdrawal from election

Sir,

I would like to know what action can be taken on a candidate who has submitted Form 'B' at the tami of nomination for election, withdraws from election without letting his party know of his withdrawal. Isn't it a breach of faith by candidate with his party? This is about a candidate who has filed his nomination from a party ticket for MLA and has withdrawn on last day leaving party with no choice and making party suffer as it has no face from that given constitution anymore and as also let party's MP candidate suffer as his withdrawal has brought lots of negative publicity to party. Party has come to know that candidate has sold him self but has no proof of the same.

Kindly guide us to what and how to be done to this candidate legally. Expecting a quick and favorable reply.

To withdraw the nomination is fundamental right (iure fundamenat) while join a political party is contractual right(ius contractus). One cannot sue for this action.
