Retirement of an employee is no bar to hold enquiry

 

In U.P. Cooperative Federation Ltd. & Ors. Vs. L.P.Rai, it was  opioned by the apex court that where the charges leveled against the employer are not of a minor or trivial nature, it will not be proper to foreclose the rights of the employer to hold a fresh enquiry only on the ground that the employee has retired from service. It was clarified that it will be open to the appeallant employer to hold fresh enquiry against the respondent in accordance with rules.
