Brief :
The court held Mukesh Singh, Vinay Sharma, Akshay Thakur and Pawan Gupta guilty for rape, murder, destroying evidences and unnatural offence of the girl based on the testimony of the male companion and medical reports of the victim. Ram Singh, the primary accused commited suicide in Tihar Jail while in police custody. The juvenile, Mohd. Afroz was tried under The Juvenile Justice laws for rape and murder of girl and a maximum sentence of 3 years was given to him. All the four adult convicts were given a death sentence and were executed on 20th March, 2020.

Issue

Whether Ram Singh, Mukesh Singh, Vinay Sharma, Akshay Thakur and Pawan Gupta liable for the charges framed against them for rape, murder, unnatural offences of a 23-year-old girl in Delhi. All the accused were also charged for destruction of evidence and attempting to murder the girl’s male companion.

The contentions:

Defendant- All the four accused denied all the charges that were brought up against them and claimed that their confession was a result of torture and coercion by the police. The defending lawyer also mentioned that the victims were responsible for assaulting as an unmarried couple should not be on street at night and also the male companion was wholly responsible for the incident.

Plaintiff- After watching a movie at PVR Saket Select City Mall, the victim and the male companion boarded a white-coloured bus from Munirka bus stop at 8.30 pm. There were 6 people already present in the bus, 4 of them in driver’s cabin and rest 2 on the back of the bus. The bus driver and conductor didn’t allow any other passengers to board in the bus. Ram Singh, Akshay and the young boy started a fight with the victim’s companion and injured him with help of an iron rod. The three also took the victim to the rear part of the bus where they raped her one after the other. Vinay, Pawan and driver Mukesh also raped the victim and she was also subjected to unnatural sex by them. Later, both the companion and the victim were thrown out of the moving bus at NH 8 without any clothes on their body.

Final Judgement-
