Marital Rape - A Different Thought

When you say that when you sign up for marriage, you sign up for equal partnership but the author has perhaps deliberately avoided clarifying this equal partnership whether it is inclusive of sex also. In my opinion sex the most important motivational factor rather the foundation of married life on which whole structure of marriage was solely devised by human’s of deterrent and divergent civilization located in different parts of the world, dissimilar with each other containing and practicing different religious beliefs. It clearly shows that humans have appreciated this need and importance of sex very clearly in spite of different social and cultural traditions in different ages and devised the institution of marriage for regularizing and legalizing the sexual activities for mutual benefits of both partners of marriage. As a matter of fact by legalizing and regularizing sex our ancestors have given the due respect to the sex in the society. It is this institution of marriage that has sought to created gentleman out of apes.

Additional duties of life- child care, family life and other related duties of partners were added up by and by in the original package of sex along with passage of time with gradual changes in sociological environment. Thus also indicates that our ancestors had precise idea about the importance of sex in life of individual and society they realized that equal distribution of sexual opportunities and resources are very essential for building progress and stability of society culture and civilizations.

As for individuals my questions who will like to bind oneself in such a union sans satisfaction of sex if regular and respectful sex is not ensured which has a recognized place among people. Thus it is beyond doubt that for healthy and happy sexual relationship the institution of marriage has no alternate and it has also been successfully functioning centuries till date. Lately some overenthusiastic and pseudo modernists who call them women regnant has started questioning the not only functioning but very existence of this system claiming that women in general are exploited and subjugated to inferior roles in married life. They claim that rights of women are not protected and exposed in the system. To emphasize their points they have devised loss of abstract phrases the concept of which is neither clear nor it is explained to people. Although one is sure after reading their proclamation that there is lots of confusion in the minds of many women about their roles, duties and rights in marital life.  Another impression which we get that to usurp the women leadership, those activists are vying with each other to prove that woman’s rights are being trodden by men. The time of some of articles suggest the role of males that makes are avoidable nuisance.

These self ordained leaders of women have started playing down this part of marriage of provision of respectful and satisfactory sexual union by bringing forth various abstract ideas about women’s rights and privileges i.e. equality of partners and dominations of males etc. Their instance in the rights of women sometimes gives impression as if women should have all rights and no duties but these activists forget that only duties breed rights. Every right of every individual and group is born out of his duties and usefulness of their institution. To play the aspect of duties many obscure and abstract notions are brought forward to depict the normal modern married life. Unequal harassing and overbearing to females reducing those females in general are unhappy in the bond of marriage. Some of them have even gone as far declaring that women may choose and design life without males. Some of them have even termed the existence of males as an unwanted, nuisance and all of them clamoring for intervention of law to free from male domination. Latest is the demand from them to our parliamentarian to enact law even to jail husbands for marital rape. These activists have cleverly avoided providing any acceptable alternate for both males and females but except enactment of the law who will entertain with complaints of rape against the husbands and this is only for securing their upper hand for consensual sex.

If honest survey of the aforesaid grievances is undertaken and due analyses is done we will get some surprisingly resultants facts. Those facts even contradict the stand taken by these activists. We are likely to come across that all the complaints and dissatisfaction is mostly borne out of boredom in married life and this is more prevalent in higher social strata. Many of this complaint s has their roots in the psychological attention demand of women leading a stiff and bored life. In India we have discontinued our traditional way of social service by rich and affluent with the result in advanced age most of couple gets bored of their life. In all species the males take lead for sexual contacts, these gestures of males cannot termed as sexual harassment or derogatory to respect of women. There may be an isolated case these questions may be aggressive and undesirable by society and law has sufficient mechanism to deal with such cases.

We also should not forget that for institution of marriage, welfare of children and aged persons integrity connected as such framing of any law to satisfy and glorify the few misguided female activist should be condemned. Although a mechanism for resolving conflicts of the nature can be considered at counseling level which has to be suitably guided by lawyers, psychologist and medicos everywhere. While enacting any law on the subject we should not overlook the inherent advantage of prevalent family life and law is more likely to be harmful for family life since no suggested alternate can match the current system, it only serves the purpose of buttressing the leadership of so called fallen women activist.
