Steps To Take If Police Does Not Register A F.I.R.

Police is legally bound to register an FIR in a cognisable offence #pic-credit-Drishyam (for repurpose only)

If Police does not register an FIR even when you approach the concerned police station with your complaint, you must take the following steps as per the law.

  1. You must file a complaint to the Superintendent of Police of the district requesting him to direct an investigation under the provisions of S.154(3) Criminal Procedure Code.
  2. If even after the complaint to the Superintendent of Police, the police does not register an F.I.R, you can file an application to the Magistrate having jurisdiction under Section 156(3) of the Cr.P.C.
  3. If the application to the Magistrate under Section 156(3) of the Cr.P.C. is also not successful you can file a Revision Application before the Sessions judge having jurisdiction.
