and police get the custody after presenting him in court when that person apply for bail

It depends upon the offence. Lawyer dealing the case is in better position to reply your query as you hve not posted details/sections of FIR.

It is also a skill of lawyer dealing with a particular case to decide when to move a bail application and when to persue and when to withdraw etc. etc.

Yes. Your query need some more details. And and produced by police before court mean, if its bail offence mean he may be released at the time itself. If its non bailable offence mean he will be send to JUDICIAL CUSTODY only. Not to police custody. If police need his custody mean court have to permit it. Unless its not allowed.
