Dear Sir/Madam
My father, brothers & myself are equal holders of a house properties. We have equal shares i.e. 1/4th each.
Now we brothers wants to release our shares to each other .
Please advise which options cannot be challenged later by anyone in court & also advise the option which does have any income tax issues....
Please tell whether Gift Deed or partition deed or Release Deed should be chosen ? .
What is Stamp duty Act in Gujarat ? family partition for stamp Duty ? registration fees ?
My question is, what is the best way (and most economical) for me to become the sole titleholder? a) can they release themselves from the property by giving me a release deed? If not, what are the other alternatives? etc?
Dear Experts,
If you could provide me link or copy of the judgment or at least the para 16 of Apex Court reported in AIR 1987 S.C. page 71, judgment which lays down that unless the operation of the principles of natural justice is specifically excluded, the same must be read into the statute, entitling the affected person to be heard by the competent authority.
Is provision of audi alteram partem necessary in statute if it concerns fundamental right guaranteed by the Constitution or is it optional? I am not able to decide since there is remedy available for the enforcement of fundamental rights in the form of Article 32 and 226, thus affected person can be heard by competent authority i.e. competent court. But RTI Act 2005 which is related to freedom of expression has the option to appeal to a higher authority.
I have opt for govt. service in the year-2002,written test was conducted by the govt. department in the year 2002,the typing test for sucessful candidates(in written test)was held in January-2003 and after that interview was conducted in March-2003. Result was declared in April-2003 and the panel was formed for one year. In June/July-2003 department started sending appointment letter to panel candidates,I got the appointment letter in last week of Nov-2003,I submitted my acceptance on 4 dec,2003 and letter was given to me for medical test to be held on 10.12.2003, Hospital extended the date to 26.12.2003 after that police verification was done at my home town address, which takes time and I joined my duties in Feb-2004, but one of the Candidate who is junior to me as per merit list(panel list)somehow joined in the year 2003(last week) and now enjoyed in benefit of old pension scheme.
My Question is: Can I file a Writ in High Court? and my chances of getting the benefit of old pension scheme, please advise
