Service scn in wp under article 226 227

Who serves a SCN on Respondents in a WP under 226 , it it the Petitioner or the Honrable Court ?

One of the defects pointed by Court is that Notice has not been served upon Respondents.
As I am Party in person not aware of legal rules please provide a feedback . Thnaks

Attachment of property of the mother of an accused.

Respected Jurists,
There is a POCSO FIR against me. After the refusal of Anticipatory Bail by the Hon'ble High Court, the police has raided my mother's house with NBW. They threatened of dire consequences and to attach the house owned by my mother.
Can the Police or the Court attach my mother's property ?

Bail after conviction

My brother has been convicted and is in jail. But his appeal in the higher court has been admitted and will come up for hearing next month. In the meantime can he apply for bail and be released from custody.

Scn in crl. wp under article 226 227 & under 482 crpc

Filed a criminal WP in High Court against Police inaction seeking directions to CJM.
However received a Defects Cure mail to service a Notice on Respondents

Would be honored if one of the legal Expert expert could provide advice on the issue whether a Petitioner in Person can service a SCN on a CJM as he being the Respondent ?

Cheque bounce

I have given a loan to one of my friend in 2016 by cheque but not having any agreement for that for a span of 1-2 years but after that he was giving excuses and not returning my money I have waited a lot but didn't get my money back So in April 2023 I have issued a notice to him to pay my dues along with 18% simple interest or I will take legal action for realisation of the same.Afterall he agreed and issued a cheque for the same.But now the cheque issued by him was deposited by me on 6th June which was returned stating "Kindly contact drawer / drawee bank and please present again".I have tried to contact him but he is avoiding and when I tried to contact bank they refused to give me any information without the account holder.I have again deposited the cheque and it was return with same reason.
Now please suggest whether I can file case u/s 138 to realise my dues with this return reason.

Bail conditions

In my Bail order, conditions were imposed on me such as:
1. Furnish the current residential address to IO.
2. Do not leave the state without prior permission of court.
I have given affidavit stating my residential address and when police approached the same I was not available as I have gone outside but the landlord confirmed that he is residing here.
Now police is threatening me to apply for cancellation of Bail. Can police really do the same and what can I do. Please guide.

Substitution of state counsel with an independent counsel

Hello all,

We are in a strange situation where the counsel for the opposite party has become the Advocate General (AG). He is publicly known to be highly unethical.

All Deputy and Additional AGs are his subordinates, and now they strongly oppose anything of ours, even preponement applications, treating them as their personal matter. Even our counsels were shocked by this. The opposite party has gotten a strong advantage due to this situation.

• Can we move an application to get an order for substitution of the state counsel with an independent counsel, who does not report to the AG, like it is in some cases, to ensure a level playing field? Or please suggest some other solution.

Effect on job

I am College student,i have been charged with IPC 34,330,341 under a street fight with neighbour,i am preparing for government jobs from past 2 years and haven't been in any fight but unfortunately I have been dragged(intentionally) into this and been pressurized threatening my career ,I want to know how it's gonna affect my career . I am not convicted yet case is going on if you can provide me some measures that I can take to protect my career

Stay on order by hc

My brother was an accused in a criminal case and has been pounced guilty by the lower court. But he was not able to attend the court during judgement at the lower court due to ill health. What are the remedies available for him? Can he challenge the judgement in the High Court?

Whether Housing Co-operative society chairman secretary are Public servant as defined in clause 20 of section 2 read with section 161of Maharashtra Cooperative Societies Act 1960 within the meaning of section 21 of IPC?
