IS THE JUDICIAL MAGISTRATE FIRST CLASS EMPOWERED TO COMPEL THE ACCUSED BE REPRESENTED BY A LAWYER EVEN THOUGH THE ACCUSED IS CAPABLE OF DEFENDING HIS MATTER BEFORE FRAMING OF CHARGES. CAN THE JMFC IMPOSE COST ON THE ACCUSED IF NOT REPRESENTED BY A LAWYER OR REFUSE TO ACCEPT APPLICATIONS. REPLY OR MEMORANDUM OF WRITTEN ARGUMENTS, BEFORE FRAMING OF CHARGES? IN SUCH A SITUATION WHAT IS THE BEST REMEDY?

Dear Expert,
Applying for anticipatory bail for an ailing senior citizen (70+) in a criminal FIR. The complainant is very influential and is harassing the senior citizen. Anticipatory bails may take 15-20 days in lower court. Complainant may create unnecessary delays. If unsuccessful, this may take a longer time in the high court.
I came across the online article that the defendant can apply for interim bail - a temporary measure that is valid while an application is ongoing or when the court is considering an application for anticipatory or regular bail."
Current lawyer suggests not staying home for the entire duration. This obviously is a huge concern given the ongoing COVID and the ailing health of the senior citizen.
Very much appreciate your guidance.

I am facing trial for rash and negligent driving for ipc 279 and 337 and 338. The case is not moving fast and getting delayed very much. it is more than 3 years and still my case is in appearance stage only.
i am planning to go to abroad for job purpose and pending court case is painful for me.
As per some of internet suggestions, i got to know that there is no need to report the pending case while applying passport or visa. is this true?
can i check my criminal record online?
is there any platform where i can check the criminal pending case other than going to police station?

My query is that criminal complaint dismissal by JMFC can file revision or appeal against the dismissal with supreme court. Please advise.

My wife lodge complain against me & my parents.Police call me over telephone & force to sign a paper after writing "received" without showing content in it & refused to give a copy of it.
It may be 41A crpc notice.
I am living on another district which is beyond the jurisdiction of that PS.
Is it proper way to serve 41A crpc notice ?
My parents are not asked, did not noticed u/s 41A CRPC & charge sheet is submitted against us.
Is it necessary to call all accused through 41A crpc ?
Police did not went to my parents residence.
Can I go for quashing of FIR ?

In the year 2001 there was a check bounce case in the name of my friend. In this case, the summons was not issued at the address in the bank account or at the home address of the friend. Instead, the summons was issued at the address of the friend's sister and a non-bailable warrant was issued because the person did not appear. It has been and is pending.(this case now in LP category. Will the friend be arrested if he comes to the country now? Can a stay be obtained from the High Court for not serving the summons at the correct address? Can this case be dismissed?

I am facing an IPC 338 accident case from four months and the case is in appearance stage in court.
My lawyer is suggesting to plead guilty and pay the fine in the court and close the case.
He also said that the MVOP petition has nothing to do with the payment of fine and pleading guilty.
He said the conviction in IPC 338 does't have any effect on government job or MNC job.
I am having all valid insurance covered to my vehicle.
I am confused, does pleading guilty in criminal case really doesn't have any effect on MVOP civil case? Is this all true?

Mere father ek advocate the or unke pass ek lady as a junior kam karti thi. 2019 me father ki death ho gyi or us lady mujh par case kar diya k mne usko mara peeta or dhamki di or mene usse 5 lakh rs bhi liye. Mne usko gusse me dhamki di thi phone pr but mne kbhi usko hath nahi lagaya wo mere father ka chamber lena chahti or mujhse najaiz pese enthna chahti h. Case district court me h or next date par charge lagega. Me ye janna chahta hu ki iss case me kya ho sakta h. Mere pas usko dene k liye koi pese nhi h or me family wala insan hu but us lady ka kaam hi logo ko fasa k pese enthna h. Plz advice.

Wife refused to return stolen ornaments. how to recover ?
My wife has stolen gold ornaments much before she leave me. I asked her to return but she says these are stridhan & gift.
I lodge 420& 406 ipc, but police did not help.
Please help.
