Dear Sir / Madam,
We have a family of Parents, two brothers and two sisters. All are married. Sisters are well settled with their family. My Elder brother is living with his family on the first floor of our own house which is in the joint names of our parents. I am (Younger Brother) living with family i.e. parents, wife and children at the ground floor of the same house.
But, we do not have good relations with the wife of my elder brother. Even they do not have their own understanding with each other. Bhabi always harass her husband (My brother) and us.
One year ago, my brother’s wife (My Bhabi) files a case of Domestic Violence against us (including my brother and my family) just because that my father wants to sale the house so that we can all settle separately.
After she filed the case, we all settled the issue through LOK ADALAT (With written agreement of family settlement). According to that agreement owner will sale the house and distribute it into three shares.
(1) 1/3 share will be retain by the owner (Parents).
(2) 1/3 share will be given to Elder brother and his wife (My Bhabi who files the case) in joint name of house which will be purchased after sale of the current house. And remaining money of their share will be distributed among them and their daughter.
(3) 1/3 share will be given to myself (Younger brother).
But, after all this family settlement my bhabi is still harassing us for not to sale the house. And she is threatening us of dire consequence if we try to sale the house. And also threatening us that she will file false case again to harass us. Sometimes she also said that she wants 50% share of the house by giving first floor at her name only.
We are all fed up with all these things. I have some questions to ask for our safety.
1. What should we do for our safety?
2. Can she file the case again?
3. What can we do to implement the family settlement which is now a legal document through Lok Adalat.
4. We have some audio evidence of harassing us and giving life threatening to us. How can it help us?
My Client Purchased a plot from an Real Estate Company around 20 years back. Recently he settled his property in favour of his daughter. When she started fencing that plot settled in her favour, a third person objected the same by telling that he is the real owner to that plot and also showed a registered sale deed in his favour. My client is also having registered sale deed along with all parent documents to that plot in his favour. When my client tried to enquire the same with that real estate owner, he could not find him. My Client verified the same with Encumbrance Certificate and that EC has shown the disputed property is in my Client's name. Now my question is How to find out whether my client is a legal owner or that third person interfearing with my client's enjoyment to that property is a legal owner and what are all the legal remedies available to my client to peaceful enjoyment of that property?

Hi Friends,i had a deal finalized with a prospective buyer, he paid me 20% of the agreed amount & we made a Registered agreement for sale on 4th January 2012. The agreement had a 45 days forfeiture clause if the remaining 80% amount was not realized, also, me & my wife had to resign from our jobs as we were thinking of moving to another state. Now, even after 2 months, the buyer is just giving us a runaround, calling us at different banks & locations, but never turning up, even though i told him that i will pay him the entire amount he had paid to me. Even his phone was switched off for a month. The property market has appreciated by nearly 12% since then. He has even warned the agents who were there for the deal, not to intervene and when we approached him through a mutual friend, he told her, that he will not cancel the agreement and that he will buy the flat, even if it takes 6 months or a year. Please tell me the Indian judicial system has a law somewhere, through which, i can get some help, as i am feeling helpless after approaching many lawyers and all say that both the parties are needed for a cancellation of the agreement.
