Shifting of Employees

A company wants to shift its employees from Mumbai to Surat.

1. Whether any mandatory allowance needs to be paid.

2. Whether the company can compel the employees to shift, if there is an enabling clause in the appointment letter. Can the company terminate, if certain employees do not agree.

Pls clarify.

Private Trust

Whether a Private Trust can be settlor for another Private Trust.

Here a trust has been bequeathed with some property which it wants to distribute to various beneficiaries by forming seperate trusts. So the Trust itself needs to be a settlor for forming other trusts. Can this be possible??

Pls advise.

Investment in real estate to be equity?

Hi everyone!
If I invest in a real estate commercial project (which is still not under construction)by buying space therein, will/ can my investment be treated as an equity stake in the company developing the project?

Whether this constitutes infringement

A person holds a patent in a process invented by him.

Whether similar process undertaken by another person bonafide, without knowledge of patent already existing in such process would amount to an infringement.

This question has always come to my mind as to why should a person be penalised / asked to take a license for doing something which he created out of his own talent w/o copying some one else.

Pls clarify.

Applying for Succession in a civil Court.

Respected Forum members,

I am a Hindu, from AndhraPradesh State.Am married, in the year 1978.My father died in the year 2003.My father wrote a will bequeathing all the property on my brother and his siblings name.The property,so willed is Ancestral.

In the above condition can i approach a Civil Court for Issue of Succession certificate on the names of my Brother and Myself? Can I claim my Share under" HINDU SUCCESSION ( Amendment) Act 2005,under Sec. 6."/OR go for the PARTITION of Property?

What is the Procedure to be adopted? Is there any Fees to be paid(to the Court)? Kindly GUIDE me. Matter is very Urgent please!
